“Win a Trip” OFFICIAL RULES – Children International House Party Host Contest

1.  SPONSOR

The Children International House Party Host Contest is sponsored by Children International, a tax exempt, charitable organization under I.R.C. §501(c)(3). The purpose of the House Party Event on August 15, 2009 is to raise money through child sponsorships which support Children International endeavors that provide assistance to children and families struggling in poverty.  To obtain a copy of these rules by mail, send a self-addressed, postage-paid, business-size envelope to the House Party Host Contest: Children International, 2000 East Red Bridge Road, PO Box 219055, Kansas City, MO 64121.

2.  CONSUMER DISCLOSURE

Hosts have not yet won. Winners will be determined by the total number of new sponsors in good standing as of November 16, 2009, that have listed the Host Name as their House Party Host on the Kid-tribution Sponsorship brochure or on www.kid-tribution.com web site. Hosts may not combine their sponsors signed with other hosts. Disclosure copies of Children International’s IRS Form 990 are available by sending a written request marked “Children International Form 990” to the address above.

3.  PRIZES / APPROXIMATE RETAIL VALUE

Each winner will receive an all-expenses-paid trip for two to visit a Children International field agency center selected by Children International.

Such trip shall consist of four days.  Additional days for travel may be necessary depending on destination. Any expenses for alcohol or entertainment outside of those specifically planned for by Children International will not be included.  Each winner will be accompanied by such staff and employees of Children International as determined by Children International.  Airfare will be via coach class.  Hotel accommodations for double occupancy will be at a hotel with at least a 3-star rating.  Winner must give Children International at least 90 days notice prior to requested travel date.  Winner will be responsible for obtaining any requisite travel documentation, including a visa and / or passport.  Any extension of the trip beyond the four days at the destination will be at the sole expense of a winner.

The retail value of the prize depends on the location of the field agency center.  Such value is estimated not to exceed $7,500.

The prize may only be transferred to the winner’s immediate family, such as parent, spouse, child (but only if reached the age of majority), or sibling.  Any other transfer of the prize is prohibited.

There is no cash redemption or substitution of prize.  The value of the prize may be taxable as income.  Each prize winner is solely responsible for all applicable federal, state and local taxes that may become due.  Each prize winner must provide a social security number for 1099/income tax filing purposes prior to the awarding of the prize.

Prize must be claimed by November 30, 2010.

4. ELIGIBILITY

Only Children International House Party “Hosts” who host a sponsorship House Party event on August 15, 2009 are eligible. This contest is not open to public sector employees where such an offer would violate laws, regulations or policies. Employees of Children International, House Party, Inc., and immediate family members (parent, child, sibling and spouse) of such individuals and persons living in the same households as such individuals (whether related or not) are not eligible to participate.

Void in Puerto Rico and where prohibited by law, rule or regulation. All federal, state and local laws and regulations of the U.S. apply.

5. HOW TO ENTER

Children International House Party Hosts will encourage party guests at their August 15th, 2009 House Party to complete the Kid-tribution Sponsorship Brochures and/or go to the web site www.kid-tribution.com to sponsor a child. They will instruct their guests to submit their Host Name in the fields provided on the forms.

  • Each new sponsor will count as one.
  • If a guest chooses to sponsor more than one child, it will still count as just one sponsor.
  • If a guest is already sponsoring a child or children through Children International, a new sponsorship will count as one sponsor, but their current accounts will not qualify.
  • If the host is already a sponsor through Children International, that sponsorship will not qualify, but if they sponsor an additional child, it will count as one sponsor.  

From July 20, 2009 until November 1, 2009, any new, unique sponsorship received from the kid-tribution.com web site or Kid-tribution Sponsorship Brochure will count toward the contest. On November 16, 2009, the sponsors signed up through Kid-tribution.com and the Kid-tribution Sponsorship Brochure will be monitored and counted as “1” if they have an account current and “in good standing”.

6. WINNER SELECTION

There are up to three available prizes.  The winners will be selected based on the Children International House Party Host with top three number of sponsors “in good standing” that their Children International House Party party generated pursuant to Section 5 of these Rules who meet the minimum new sponsorship requirements. Prizes will only be awarded to House Party Hosts who have at least five (5) new and unique sponsors pursuant to Section 5 of these Rules.

If a tie-breaker is needed to select a maximum of three total winners due to Children International House Party Hosts having the same number of sponsors meeting the eligibility requirements of this Section 6, the remaining winners will be selected by a random drawing from those Children International House Party Hosts having the same number of sponsors.

Sponsors will need to have accounts in good standing as of November 16, 2009.  Selection of the winners will be on the Children International website at http://www.children.org.  Winners will also be notified by mail.

Each prize winner will be required to complete, sign and return Affidavits of Eligibility, Waivers of Liability and Publicity Releases.  Failure to comply with these Official Rules or to claim a prize will result in disqualification of a prospective winner and a selection of an alternate winner.

7.  ENTRANTS PERSONAL INFORMATION

Information collected from entrants is subject to the Children International Privacy Notice which can be found at http://www.children.org/privacy.asp.

8.  GENERAL CONDITIONS

By participating in this contest as a Children International House Party Host, entrants agree to be bound by these Official Rules and the decisions of the judges, which are final in all respects. By entering, entrants agree and acknowledge that Children International and its employees, officers, and directors are not responsible for and shall not be liable for:

  • (i)    late, lost, delayed, misdirected, incomplete, unreadable, inaccurate, or illegible entries;
  • (ii)    any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use or misuse of any prize or from participating in the contest; or
  • (iii)    postage-due mail, any printing, typographical, administrative or technological errors in any material associated with the contest.

The contest is subject to all applicable federal, state and local laws, rules and regulations.

Children International reserves the right to disqualify any individual they find to be tampering with the entry process or operation of the contest; to be acting in violation of these Official Contest Rules; or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass Children International or any other persons.  ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, CHILDREN INTERNATIONAL RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULL EXTENT PERMITTED BY LAW.

Children International reserves the right, in its sole discretion, to modify, cancel or suspend this contest should any cause or problem corrupt or inhibit the administration, security or proper operation of the contest and, in such situation, to select the winner from entries received prior to the action taken or in such manner as deemed fair and appropriate by Children International.

Children International may use winner's name, likeness and city name for promotional purposes without additional compensation, except where prohibited by law.

ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL CONTEST RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR CONTEST ENTITIES IN CONNECTION WITH THIS CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MISSOURI WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN. EACH PERSON WHO PARTICIPATES IN THIS CONTEST AGREES THAT THE STATE AND FEDERAL COURTS LOCATED IN KANSAS CITY, MISSOURI SHALL HAVE EXCLUSIVE JURISDICTION OVER ANY SUIT OR OTHER PROCEEDING ARISING OUT OF OR BASED UPON THESE OFFICIAL CONTEST RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR CONTEST ENTITIES IN CONNECTION WITH THIS CONTEST AND EACH HEREBY WAIVES ANY CLAIM THAT IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE.

9.  LIMITATION ON LIABILITY

Children International assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, or any problem or technical malfunction of any network, whether data or voice, lines, or any combination thereof, which may limit an entrant’s ability to participate in this contest.

By entering this contest, each Children International House Party Host agrees that:

(i)    any and all disputes, claims, and causes of action arising out of or in connection with the contest or any prizes awarded, shall be resolved individually, without resort to any form of class action;

(ii)    any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the contest, but in no event will attorneys’ fees be recoverable; and

(iii)    under no circumstance will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives any rights to, punitive, incidental or consequential damages and/or any damages other than actual out-of-pocket expenses

Each winner, by accepting the prize, agrees to release and hold harmless Children International and House Party, Inc. from any and all liability, claims or actions of any kind whatsoever, which may result from the receipt, enjoyment, ownership, use or misuse of such prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the entrant’s rights of publicity or privacy, or the entrant’s claim that he/she has somehow been defamed or portrayed in a false light).

10. WINNERS LIST

You may obtain the name of the prize winners by going to the Children International website (www.children.org) on or about November 17, 2009.

Your party package will be shipping out on July 29th and should arrive by August 4th.
